The Utah Division of Occupational and Professional Licensing amended a petition against Carl W. Barney to include the personal observations of an investigator for the Legal Center for People with Disabilities. The petition said Herman Govan's observations were corroborated by the Utah Department of Health.

Mr. Barney's attorney, Dale Stratford, said the state's allegations are "basically untrue." "This has been going on for some time," he said. "Every time we get them to the point where they're weak on one thing, they amend it again." The petition filed in August accused Mr. Barney, owner and operator of Country Meadows Convalescent Center, of unprofessional conduct, despite two failed attempts to convict him of criminal charges stemming from the same allegations. In 1988, Mr.

Barney was found not guilty by a 2nd Circuit judge of assaulting one of the patients named in the licensing petition. Criminal assault charges filed in 2nd District Court in January 1991, naming several other patients in the petition, were dismissed. Royal Simpson, manager of the health department's Bureau of Facility Review, confirmed the center has been cited for several chronic deficiencies. But the center meets most qualfications and remains for Medicaid and Medicare reimbursem*nt, he said. Deficiencies identified in February included: The lack of a separate accounting system for residents' money.

Charging residents for personal hygiene items that should be included in treatment costs. Failing to dress residents appropriately. The facility also failed to document that before restraining four residents, less restrictive methods were tried and that the restraints were loosened every two hours. Mr. Simpson said owners of the center have been "cooperative" in correcting problems.

State Officials Lift Trust-Fund Freeze; Navajo Advocate Criticizes Endowment By Tony Semerad THE SALT LAKE TRIBUNE Officials agreed Tuesday to temporarily lift a freeze on the Utah Navajo Trust Fund and spend $500,000 to help create a major scholarship endowment at the College of Eastern Utah. The decision ignores worries from some Navajos that the money won't be spent properly. The $500,000 would be part of a $6 million endowment for the Price-based college, with $2 million from state and local sources and a 2-for-1 match of $4 million from the federal government.

Interest from the fund will help pay tuition for American Indian students at the college. "What we're risking is nothing to get a very high return," board member Gordon Crabtree said. The rest of the $2 million has been pledged by the state Division of Indian Affairs, San Juan County, the White Mesa Ute tribal council and private sources. But Marilyn Ellingson, an advocate for Utah Navajos, said the expense is unjustified. Only basic programs are available at the College of Eastern Utah satellite campus in San Juan County, where most Utah Navajos live, she said.

The scholarships could not be used to attend other colleges or universities. "This is outrageous," Ms. Ellingson said. "It's a racist maneuver to limit these kids' educations." Controversy has been a common companion of the trust fund since a legislative audit last November revealed it had been sapped of more than $50 million through waste, mismanagement and purported corruption. Virtually all spending from the fund, which now stands at $10.1 million, has been frozen since the audit.

The fund was created in 1933 to promote Navajo health, educational and general welfare. It is financed with royalties paid by oil companies operating on the Aneth Extension of the Utah portion Accidents Near Price, S. Elfriede S. Mueller The vehicle rolled several times into the median and ended up in the south lanes during the 6 p.m. accident, Mr. Johnson said. Her brother-in-law, Richard Jensen, 26, was critically injured and died Tuesday morning at University Hospital in Salt Lake City.

Mrs. Jensen's husband, Robert, was in good condition Tuesday at Dixie Regional Hospital. Richard Jensen's wife, Margo, and their infant son also were in good condition. All were wearing seatbelts. Teens Slam Truck Into Orem Home By Cornelia deBruin SPECIAL TO THE TRIBUNE OREM Ralf and Suzy Barnes were enjoying a quiet evening in their home Saturday when a speeding truck broke their serenity and house.

"We heard an incredibly loud noise like someone was bulldozing our house," said Mr. Barnes. A group of teen boys who allegedly stole some beer and a truck slammed into the Barnes' home, narrowly missing a natural-gas line, say officials. The boys also caused approximately $20,000 damage to three yards, two houses, and a garage in a north Orem neighborhood. Orem police Detective Gerald Nielsen said the truck made a "clockwise sweep across the lawn, went through a 6-foot fence, bounced off a house, then crashed through a garage wall and out of the garage No one was injured in any of the crashes.

"We've had people go off the road and hit a house before, but never something like this," said Detective Nielsen. The boys, ages 15 to 17, were caught a short distance away from the scene. Mr. Nielsen said they allegedly stole beer from a 7. Eleven store earlier in the evening.
